1. Agreement to Terms

By accessing or using the services provided by Coaching Dev Labs (“Company,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use our services.

Coaching Dev Labs provides custom website design, development, hosting, and ongoing support services primarily for life coaches, wellness professionals, and related service providers. Our services include but are not limited to:

3. Client Responsibilities

You are responsible for providing accurate information through our discovery form and any subsequent communications. You are also responsible for reviewing and approving designs and content before your website is published. You must ensure that any content you provide (text, images, logos) does not infringe on third-party intellectual property rights.

4. Payments and Billing

Website build fees are due according to the schedule outlined in your project proposal. Hosting fees are billed monthly or annually, depending on your selected plan. All fees are non-refundable unless otherwise stated. We reserve the right to suspend services for overdue accounts after providing reasonable notice.

5. Intellectual Property

Upon full payment, you own the custom design and content created specifically for your website. We retain rights to our underlying tools, code, and frameworks. We may feature your website in our portfolio unless you request otherwise in writing.

6. Hosting and Uptime

We strive to maintain 99.9% uptime for hosted websites. However, we do not guarantee uninterrupted service and are not liable for downtime caused by factors outside our reasonable control, including third-party service outages, natural disasters, or scheduled maintenance (for which we will provide advance notice when possible).

7. Termination

Either party may terminate the hosting agreement at any time with 30 days’ written notice. Upon termination, we will provide you with an export of your website content and assets. Website build agreements may be terminated by either party if the other party materially breaches these Terms and fails to cure the breach within 14 days of written notice.

8. Limitation of Liability

To the maximum extent permitted by law, Coaching Dev Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, arising from your use of our services. Our total liability shall not exceed the total amount paid by you to us in the 12 months preceding the claim.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any disputes shall be resolved in the courts of the State of Florida.

10. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and updating the “Last updated” date. Your continued use of our services after such changes constitutes acceptance of the updated Terms.
